These Terms and Conditions (“Terms”) govern access to and use of GetSportWidgets, including the GetSportWidgets website, Widget Builder, embedded Widgets and related services and infrastructure (collectively, the “Service”).

The Service is operated by the provider identified in our Legal Notice (“GetSportWidgets”, “we”, “us” or “our”).

By accessing the Service, creating or configuring a Widget, publishing or embedding a Widget, creating an account, or purchasing a Pro subscription, you agree to these Terms.

If you use the Service on behalf of a company, organisation or other legal entity, you confirm that you have authority to accept these Terms on its behalf.

If you do not agree to these Terms, you must not use the Service.

1. Definitions

For the purposes of these Terms:

“Widget” means an embeddable sports-related component generated or provided through GetSportWidgets.

“Free Widget” means a Widget that is published, embedded or rendered without active Pro functionality, subject to the Free service conditions described below.

“Pro Feature” means functionality identified as requiring an active Pro subscription, including features such as removal of GetSportWidgets advertising and branding, odds functionality, domain protection, additional design or configuration options, and other features identified as Pro within the Service.

“Widget Owner” means the individual or entity that creates, configures, publishes, controls or is otherwise responsible for a Widget.

“Widget Configuration” means the design, appearance and display settings selected by a user through the Widget Builder, including colours, layouts, styles, language, visibility options and other configuration controls made available by the Service.

“Business User” means a person or entity using the Service for purposes relating to a trade, business, profession or commercial activity.

“Consumer” means an individual using the Service primarily for purposes outside their trade, business or profession.

2. The Service

GetSportWidgets provides tools for creating, configuring and embedding sports Widgets on websites, applications and other digital properties.

The Service may include sports scores, fixtures, results, statistics, rankings, team and player information, competition information, odds-related functionality, images, logos, names and other sports-related content.

Widgets may be rendered under Free service conditions or with Pro Features, depending on the Widget Owner's current plan and entitlements.

The availability, design and functionality of the Service may evolve over time in accordance with these Terms.

3. Free Widgets

Free Widgets may be configured, published and embedded without an active Pro subscription.

Unless expressly stated otherwise, Free Widgets may contain:

GetSportWidgets branding;
advertising;
GetSportWidgets promotional or self-promotional content; and
limitations on features or configuration options.

Users of Free Widgets must not remove, conceal, obstruct, alter or circumvent GetSportWidgets branding, advertising, promotional elements or technical restrictions associated with the Free service.

A website or application displaying a Free Widget may itself be commercial, advertising-supported or otherwise monetised.

Use of Free Widgets does not require the Widget Owner to purchase a Pro subscription.

4. Pro Features

Certain features are available only with an active Pro subscription.

Unless expressly stated otherwise, Widget types may be configured, published and embedded under the Free service conditions without an active Pro subscription. Their availability in the Widget Builder does not mean that Pro Features are active unless the Widget Owner has the required Pro entitlement.

While an eligible Pro subscription is active, the subscriber may:

use Pro-only functionality on eligible Widgets;
remove GetSportWidgets advertising from eligible Widgets;
remove GetSportWidgets branding from eligible Widgets;
enable odds functionality where supported;
use Pro domain protection for Pro-enhanced rendering; and
access other features identified as included in the applicable Pro plan.

Specific Pro functionality may vary as the Service evolves.

GetSportWidgets does not provide a free trial of Pro unless a trial is expressly offered as part of a specific promotion.

Access to Pro functionality begins only after the applicable subscription has been successfully activated.

5. Expiry, Cancellation or Loss of Pro Access

When a Pro subscription expires, is cancelled, is not successfully renewed or otherwise becomes inactive, the following rules apply.

5.1 Widgets continue in Free mode

A Widget will continue to operate where technically available, but will automatically operate under the Free service conditions.

This may include:

GetSportWidgets advertising or promotional content reappearing;
GetSportWidgets branding reappearing;
odds functionality being removed or disabled;
Pro domain protection ceasing to apply; and
other Pro-only settings or functionality being disabled.

Pro-specific configuration may remain stored by GetSportWidgets while it is inactive. This allows that configuration to become available again if Pro access is later restored.

Retention of such configuration does not mean that Pro features remain active while the account is Free.

5.2 Existing embed codes

Existing embed codes normally remain unchanged when an account changes between Free and Pro.

The functionality delivered through an embed is determined by the Widget Owner’s current plan and entitlement when the Widget is loaded.

Changes in plan status may take a short period to propagate because of caching or other normal technical processing.

5.3 Builder restrictions

A user without an active Pro subscription may not activate Pro-only functionality.

Pro-only configuration submitted while the user does not have Pro access may be rejected, ignored or removed from the active configuration.

6. Pro Subscriptions, Billing, Refunds and Paddle

Paid subscriptions are processed through Paddle.

Paddle acts as Merchant of Record and authorised reseller for transactions processed through its platform. Payment processing, applicable taxes, transaction confirmations, subscription billing, statutory withdrawal rights and refunds may therefore also be governed by Paddle's applicable Buyer Terms and Refund Policy.

Pro subscriptions automatically renew for successive subscription periods unless cancelled before renewal.

The applicable price, billing period, currency and taxes are displayed at or before checkout.

Refunds and Cancellations

Except where required by applicable law or Paddle's applicable Buyer Terms or Refund Policy, payments for Pro subscriptions are non-refundable.

GetSportWidgets does not provide refunds or credits solely because:

a subscriber changes their mind after purchasing Pro;
a subscriber does not use or makes limited use of the Service;
a subscriber cancels before the end of a paid billing period;
a subscriber no longer requires the Service; or
a subscriber fails to cancel before a scheduled renewal.

Subscriptions may be cancelled at any time. Cancellation prevents future renewals but does not normally terminate the current paid subscription period. Pro access will remain available until the end of that period unless the relevant transaction is refunded, reversed or otherwise cancelled.

No prorated refund or credit is provided for unused portions of a billing period unless required by applicable law.

Where applicable law provides a Consumer with a statutory withdrawal or refund right, that right remains unaffected. Any waiver, expiry or loss of such right applies only where, and to the extent, permitted by applicable law and after any consent, acknowledgement, request or confirmation required by applicable law has been obtained.

Refund requests are processed through Paddle in accordance with Paddle's applicable Buyer Terms and Refund Policy.

A refund may be approved in exceptional circumstances at the discretion of Paddle or GetSportWidgets, as applicable. Any refund will be processed through Paddle. The granting of a discretionary refund in one case does not create an obligation to grant a refund in any other case.

If a payment is refunded, reversed or charged back, access to the corresponding Pro subscription may end immediately. Widgets and features will then operate according to the user's resulting subscription status, as described in these Terms.

7. Licence to Use Widgets

Subject to these Terms, GetSportWidgets grants you a limited, non-exclusive and non-transferable right to configure, publish and display Widgets on websites, applications and other digital properties that you own, operate or are authorised to manage.

Unless expressly stated otherwise, there is no predetermined limit on the number of authorised websites or domains on which Widgets may be displayed.

Widgets may be used as part of commercial services.

You may, for example, display Widgets on:

sports websites;
news and media websites;
fan or community websites;
club or organisation websites;
applications and digital products;
subscription-supported websites;
advertising-supported websites;
affiliate websites; and
lawful betting, gaming or gambling-related websites.

You may monetise the website, application or digital property on which a Widget appears.

This licence does not permit you to sell, sublicense, redistribute or provide access to the GetSportWidgets Service itself as a separate product or service unless we expressly agree otherwise.

GetSportWidgets permits use of Widgets on lawful betting, gaming, gambling and related affiliate properties.

GetSportWidgets does not provide gambling licences, regulatory approvals or legal authorisation for a Widget Owner's activities.

Widget Owners are solely responsible for ensuring that their business, publication, advertising, odds display and other gambling-related activities comply with the laws and licensing requirements applicable to them and to the territories in which they operate.

The availability of odds functionality or other betting-related information through GetSportWidgets does not represent a statement that a particular betting or gambling activity is lawful in any jurisdiction.

9. Third-Party Names, Logos and Intellectual Property

Widgets may contain names, logos, badges, flags, trademarks, competition identifiers, team identifiers, player identifiers and other material associated with third parties.

GetSportWidgets does not claim ownership of third-party club, team, league, federation, competition or organisation logos, badges, trademarks, trade names or other protected identifiers.

All rights in such material remain with their respective rights holders.

Third-party names, logos, badges and similar identifiers may also appear within the Widget Builder, previews, demonstrations, screenshots and other materials used to present or explain the functionality of GetSportWidgets.

Such use is solely for identification, informational and demonstrative purposes, including identifying the relevant team, club, competition or sporting event and illustrating how a Widget may appear when configured.

The appearance of any third-party name, logo, badge or trademark in the Service, Widget Builder, previews, screenshots or promotional materials does not imply sponsorship, endorsement, affiliation, partnership or authorisation by the relevant rights holder.

Third-party logos and similar visual assets may be hosted, cached or delivered through infrastructure operated or controlled by GetSportWidgets.

Their availability through the Service, their presence on infrastructure operated by GetSportWidgets, or their appearance within a Widget does not constitute:

a transfer of ownership;
a licence from the relevant rights holder;
an endorsement by the rights holder;
a representation that the material is in the public domain; or
a representation that the material may lawfully be used for every purpose or in every jurisdiction.

Certain third-party visual assets may be enabled by default when a Widget is created.

Where the Service provides a configuration option to disable the display of such assets, the Widget Owner may use that option at any time.

The Widget Owner is responsible for determining whether its use and display of third-party intellectual property is appropriate and lawful for its particular website, application, territory and use case.

GetSportWidgets may remove, replace, disable or cease providing any third-party logo, badge, image, name or other identifier where we reasonably consider this necessary, including because of:

a request or complaint from a rights holder;
legal or regulatory requirements;
uncertainty regarding applicable rights;
changes in data or content availability; or
operational or technical considerations.

The availability of any particular third-party logo, image or identifier is not guaranteed as a permanent feature of the Service.

Rights-holder requests

A person who believes that material made available through GetSportWidgets infringes its intellectual property rights may contact us using the contact information in our Legal Notice.

A notice should identify the relevant right, the material concerned, where it appears and sufficient information for us to understand and evaluate the request.

10. Sports Data and Factual Information

GetSportWidgets may collect, organise, process, normalise, calculate, combine and display sports-related factual information.

This may include fixtures, match results, scores, events, statistics, rankings, player information, team information and competition information.

GetSportWidgets does not claim exclusive ownership of sporting facts merely because they are displayed through the Service.

However, the software, processing, organisation, presentation, selection, compilation, derived information and other protectable elements created by GetSportWidgets may be protected by copyright, database rights or other applicable rights.

Nothing in these Terms grants users ownership of GetSportWidgets software, databases, compilations or other protected elements of the Service.

Similarly, nothing in these Terms is intended to grant rights belonging to third-party data providers, database owners or other rights holders.

11. Accuracy and Timeliness of Sports Information

Sports information can change rapidly and may originate from multiple sources.

Scores, fixtures, kickoff times, statistics, rankings, odds, player information and other data may occasionally be:

delayed;
incomplete;
inaccurate;
subsequently corrected; or
unavailable.

GetSportWidgets may correct or update information at any time.

Unless expressly agreed in a separate written agreement, GetSportWidgets does not guarantee that sports information will be error-free, complete or delivered within a specific number of seconds or minutes.

Users should not rely on GetSportWidgets as the sole source for decisions where exact real-time accuracy is critical.

In particular, GetSportWidgets does not warrant sports information as a guaranteed basis for placing wagers, settling bets, making financial decisions or determining official sporting outcomes.

Official competition organisers and other authoritative sources should be consulted where official confirmation is required.

Free and Pro plans do not have a predefined monthly quota for legitimate Widget views or ordinary Widget requests unless a specific plan is expressly identified otherwise.

There is also no standard predetermined domain limit for ordinary Widget use.

Accordingly, references to “unlimited” Widget views, requests or domains mean that GetSportWidgets does not impose a standard numerical usage allowance that a Widget Owner must monitor as part of normal use.

“Unlimited” does not mean that GetSportWidgets undertakes to provide infinite computing, network or infrastructure capacity in every circumstance.

Both Free and Pro plans are subject to the Fair Usage Policy below.

A Pro subscription does not by itself provide a separate or higher standard Widget-view allowance than the Free service.

13. Fair Usage Policy

GetSportWidgets is intended to support both small websites and high-traffic digital properties.

Legitimate high traffic is not, by itself, considered abuse.

Where legitimate and sustained usage reaches a level that:

creates materially disproportionate infrastructure requirements;
creates materially disproportionate costs;
affects or risks affecting the performance or availability of the Service for other users;
requires a materially different technical architecture; or
would reasonably be better served through dedicated or customised infrastructure,

GetSportWidgets may contact the Widget Owner to discuss the situation.

Possible solutions may include:

optimising Widget implementation;
reducing unnecessary or duplicate requests;
caching or other technical improvements;
infrastructure changes; or
moving the relevant usage to a Custom Plan.

GetSportWidgets does not publish a fixed traffic threshold that automatically determines when these discussions occur.

Traffic patterns, infrastructure requirements and technical costs can differ substantially between implementations, and situations may therefore be assessed individually.

Where action is being considered solely because of legitimate high traffic, we will normally make reasonable efforts to contact the Widget Owner before imposing restrictions and to identify a reasonable technical or commercial solution.

If no reasonable solution can be reached and the relevant usage continues to impose materially disproportionate requirements on the Service, GetSportWidgets may apply reasonable technical limits or discontinue the affected usage after reasonable notice, subject to any mandatory rights applicable to the user.

This process does not apply where immediate action is reasonably required because of abuse, an attack, security risk, unlawful activity or a threat to the integrity or availability of the Service.

14. Prohibited Uses and Abuse

You must not use the Service to:

violate applicable law or regulations;
infringe the intellectual property, privacy or other legal rights of another person;
distribute malware or malicious code;
attack, overload, disrupt or interfere with the Service or its infrastructure;
generate artificial, fraudulent or deliberately wasteful request volumes;
bypass or attempt to bypass authentication, plan restrictions, access controls, rate protections or security mechanisms;
remove, suppress or circumvent advertising or branding required by the Free service;
obtain or activate Pro functionality without an applicable Pro entitlement;
reverse engineer or attempt to derive non-public source code from the Service except where such restriction is prohibited by law;
systematically extract or harvest data from the Service for the purpose of recreating a database, feed or competing service unless expressly authorised;
use Widgets or their supporting endpoints as an unauthorised substitute for a data API;
proxy or retransmit the Service in a manner that makes it available to unrelated third parties as a standalone service;
resell, sublicense or redistribute the Service itself without permission;
impersonate another user or misrepresent your relationship with GetSportWidgets; or
interfere with technical mechanisms used to enforce Free or Pro functionality.

Search-engine indexing, normal browser activity and legitimate user traffic are not considered prohibited automated extraction solely because they involve automated systems.

GetSportWidgets may take immediate technical action where reasonably necessary to protect the Service against attacks, fraud, security threats or clear abuse.

15. Domain Protection

Certain plans may provide domain protection or similar restrictions intended to limit where Pro-enhanced rendering of a Widget may be used.

If a Widget is embedded on a domain that is not authorised for Pro-enhanced rendering, the Widget may continue to render under Free service conditions, including advertising, branding and without Pro-only functionality.

Domain protection is a technical access-control feature. It is not a guarantee that embed code, information, network requests or other elements can never be copied, reproduced, intercepted, circumvented or accessed by an unauthorised party.

Widget Owners remain responsible for protecting credentials, account access and any sensitive information under their control.

Users may configure the design, appearance and display settings of Widgets using the options made available through the Widget Builder.

Widget Configurations may include colours, layouts, styles, language, visibility settings and other design or display options supported by the Service.

Users do not upload or provide sports data, team or competition information, logos, images or other sports-related content through the Widget Builder.

GetSportWidgets may store, process and apply Widget Configurations as reasonably necessary to provide the Service, maintain saved configurations and render the relevant Widgets.

Creating or saving a Widget Configuration does not transfer ownership of the underlying Widget technology, templates, software, sports data, visual assets or other elements of the Service.

Available configuration options may change as the Service evolves. Where a configuration option is changed, removed or no longer supported, GetSportWidgets may adapt the affected Widget Configuration as reasonably necessary for continued operation of the Widget.

17. GetSportWidgets Intellectual Property

Except for third-party materials, the Service and its original elements are owned by or licensed to GetSportWidgets.

This includes, where applicable:

software;
source and object code;
Widget technology;
user interfaces;
original designs;
documentation;
APIs and internal interfaces;
branding;
trademarks;
original graphics;
database structures;
data processing and transformation systems; and
original compilations and derived materials.

Using the Service does not transfer ownership of these materials to you.

You may use them only to the extent necessary to use the Service as permitted by these Terms.

18. Advertising and Third-Party Services

Free Widgets may display advertising, promotional material or GetSportWidgets self-promotion.

Advertising may be provided directly by GetSportWidgets or through third-party advertising or technology providers.

The presence of third-party advertising or links does not necessarily mean that GetSportWidgets endorses the relevant advertiser, website, product or service.

The Service may also depend on third-party hosting, infrastructure, payment, analytics, data or other technology services.

GetSportWidgets is not responsible for independent third-party services outside its reasonable control.

Pro removes GetSportWidgets advertising and branding from eligible Widgets while the applicable Pro entitlement remains active.

19. Privacy and Data Protection

Use of the Service is also subject to the GetSportWidgets Privacy Policy.

Embedded Widgets may process technical information required for their operation, security, performance, analytics, advertising or other disclosed purposes.

Widget Owners are responsible for providing any disclosures, privacy notices or consent mechanisms required by applicable law in connection with their own websites, applications and use of Widgets.

Where advertising or other technology requires consent under applicable privacy or electronic communications law, the Widget Owner remains responsible for ensuring that its own implementation satisfies obligations applicable to it.

Nothing in this section reduces GetSportWidgets' own obligations under applicable data protection law.

20. Availability and Service Levels

We aim to maintain a reliable and performant Service.

However, unless expressly agreed in a separate written Custom agreement, Free and Pro plans do not include a contractual service-level agreement or guaranteed uptime.

The Service may occasionally be interrupted because of:

maintenance;
software deployments;
infrastructure failures;
third-party outages;
network conditions;
data-provider issues;
security incidents;
unusually high traffic;
legal requirements; or
circumstances outside our reasonable control.

We may perform maintenance or emergency work where reasonably necessary.

21. Changes to the Service

GetSportWidgets may develop, update or modify the Service over time.

Reasons may include:

adding or improving features;
adapting to new technologies;
security requirements;
scaling infrastructure;
changes in sports data availability;
rights-holder requests;
legal or regulatory requirements;
removal of obsolete functionality; or
other legitimate operational reasons.

Free features and Free Widgets may be added, modified or discontinued from time to time.

For active paid services, we will comply with applicable law regarding material modifications.

Where required by applicable consumer law, users will be informed of a modification that materially and negatively affects their access to or use of a paid digital service and will receive any applicable right to terminate or other remedy required by law.

Nothing in these Terms guarantees permanent availability of any particular sports competition, logo, data point, Widget type or non-core feature.

22. Suspension and Termination

GetSportWidgets may suspend or restrict access to all or part of the Service where reasonably necessary because of:

a material or repeated violation of these Terms;
fraud or suspected fraud;
a security incident or threat;
unlawful activity;
infringement of third-party rights;
non-payment or reversal of a paid transaction;
abuse of the Service;
attempts to circumvent Free or Pro restrictions;
legal or regulatory requirements; or
a need to protect the integrity or availability of the Service.

Where appropriate and reasonably possible, we may provide notice and an opportunity to resolve a remediable breach before terminating access.

Immediate action may be taken where delay could reasonably expose GetSportWidgets, its users, infrastructure or third parties to harm, unlawful activity, security risk or significant disruption.

Legitimate high traffic alone will normally be dealt with under the Fair Usage Policy rather than treated as abuse.

Users may stop using the Free service at any time.

Paid subscriptions may be cancelled in accordance with Section 6.

23. Closing an Account and Stored Configuration

Closing an account or terminating use of the Service may result in loss of access to Widgets and stored configuration associated with that account.

GetSportWidgets may retain certain information where reasonably necessary for:

legal compliance;
fraud prevention;
security;
dispute resolution;
accounting;
enforcement of these Terms; or
other purposes described in our Privacy Policy.

Where applicable law gives a Consumer rights concerning content created or supplied while using a digital service, those rights remain unaffected.

24. Disclaimer of Warranties

The Service, Widgets and all sports information made available through GetSportWidgets are provided on an “as is” and “as available” basis.

GetSportWidgets does not guarantee that:

sports data will always be accurate, complete or current;
scores, fixtures, schedules, statistics, rankings, odds or other information will be free from errors or delays;
every competition, match, team, player or data point will always be available;
the Service or any Widget will be continuously available or uninterrupted;
errors will always be corrected immediately;
third-party logos, images or other content will remain available;
the Service will satisfy any particular commercial, technical, regulatory or business requirement; or
the Service will be suitable as the sole basis for betting, gambling, financial or other decisions.

Coverage gaps, delays, corrections, technical interruptions and data discrepancies may occur.

Use of GetSportWidgets and reliance on information provided through the Service are at the user's own risk.

To the fullest extent permitted by applicable law, all warranties, representations and conditions not expressly stated in these Terms are excluded.

Nothing in this Section excludes mandatory rights that cannot lawfully be excluded.

25. Liability

To the fullest extent permitted by applicable law, GetSportWidgets accepts no responsibility or liability for losses, damages or other consequences arising from or relating to the use of, reliance on, inability to use, suspension or termination of the Service or any Widget.

This includes losses or damages arising from:

inaccurate, incomplete, delayed or unavailable sports data;
errors in scores, fixtures, schedules, statistics, rankings, odds or other information;
coverage gaps or corrections to previously supplied information;
downtime, interruptions or technical failures;
changes to or discontinuation of Widgets, features, competitions or data;
removal or unavailability of third-party logos, images or other identifiers;
advertising or promotional content displayed through Free Widgets;
third-party services, infrastructure, content or data;
decisions made using information obtained through the Service;
betting, gambling, gaming or similar activity;
a Widget Owner's configuration, implementation or use of a Widget; or
claims, complaints or losses suffered by the customers, visitors, users, advertisers, partners or other third parties of a Widget Owner.

To the fullest extent permitted by applicable law, GetSportWidgets will not be liable for any direct or indirect commercial loss, including:

loss of profits;
loss of revenue;
loss of advertising revenue;
loss of business;
loss of traffic or audience;
loss of customers;
loss of contracts or commercial opportunities;
loss of anticipated savings;
loss of winnings or expected winnings;
business interruption;
loss of goodwill;
loss or corruption of data; or
consequential, incidental, special or similar loss or damage.

GetSportWidgets is not responsible for winnings obtained or losses suffered on third-party websites, applications, betting platforms or other services that use or display information supplied through GetSportWidgets.

GetSportWidgets is also not responsible for claims arising from data errors, omissions, registration errors, spelling errors, delayed updates or other inaccuracies in sports information.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

For Consumers, nothing in these Terms limits mandatory statutory rights or remedies that cannot lawfully be excluded.

26. Business User Responsibility and Indemnity

Business Users use the Service at their own commercial risk and remain responsible for determining whether the Service is appropriate for their intended purpose.

A Business User is responsible for its own website, application, publication, business activities and use of information obtained through GetSportWidgets.

To the fullest extent permitted by applicable law, a Business User agrees to indemnify GetSportWidgets against third-party claims, damages, liabilities and reasonable costs arising from:

the Business User's unlawful use of the Service;
a material breach of these Terms;
infringement of third-party rights caused by the Business User's implementation or use of the Service; or
the Business User's operation of a betting, gambling, gaming, affiliate or other regulated activity.

This indemnity does not apply to the extent that a claim results from conduct for which GetSportWidgets cannot lawfully exclude responsibility.

27. Force Majeure

GetSportWidgets is not responsible for delay or failure caused by events outside its reasonable control.

Such events may include major network failures, hosting or infrastructure outages, acts of government, changes in law, natural disasters, war, civil disturbance, widespread cyberattacks, major third-party provider failures or other comparable events.

This section does not limit rights that cannot lawfully be excluded.

28. Custom Plans

High-volume, specialised or enterprise users may enter into separate Custom Plan arrangements with GetSportWidgets.

A Custom Plan may include different:

infrastructure;
technical arrangements;
support;
service levels;
pricing;
usage conditions; or
contractual terms.

Where a separate written Custom agreement conflicts with these Terms, the Custom agreement will prevail to the extent of that conflict.

29. Changes to These Terms

We may update these Terms where reasonably necessary, including to reflect:

changes to the Service;
new features;
changes in law or regulation;
security requirements;
changes to payment or infrastructure arrangements; or
clarification of existing provisions.

The current version will be published through GetSportWidgets together with its effective or updated date.

Where a change materially affects an active paid subscription, we will provide notice where reasonably required and comply with any mandatory legal requirements concerning such changes.

Where applicable law requires a user's express agreement to a particular change, that change will not be imposed solely through continued use of the Service.

Continued use of the Service after other changes become effective constitutes acceptance of the updated Terms.

30. Governing Law and Disputes

These Terms and the relationship between you and GetSportWidgets are governed by the laws of Romania, except where mandatory applicable law provides otherwise.

Consumers

If you are a Consumer, the choice of Romanian law does not deprive you of mandatory protections granted by the law that would otherwise apply to you, including mandatory protections of the country in which you habitually reside where applicable.

Nothing in these Terms restricts a Consumer from bringing a claim before a court that has jurisdiction under mandatory applicable law.

Business Users

For Business Users, disputes arising from or relating to these Terms or the Service are subject to the jurisdiction of the competent courts at the registered office of the GetSportWidgets provider in Romania, unless a separate written agreement provides otherwise.

Before starting formal proceedings, the parties are encouraged to attempt in good faith to resolve the dispute through direct communication.

31. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

A failure by GetSportWidgets to enforce a provision on one occasion does not waive the right to enforce that provision later.

You may not transfer your rights or obligations under these Terms in a manner that would materially affect the operation of the Service without our consent.

GetSportWidgets may transfer these Terms as part of a merger, corporate restructuring, sale of business or transfer of the Service, subject to applicable law and without reducing mandatory Consumer rights.

Headings are provided for convenience and do not affect interpretation.

These Terms, together with any applicable plan description, Legal Notice and separate Custom agreement, constitute the agreement governing your use of the Service.

Payment transactions through Paddle are additionally subject to the terms applicable to that transaction.

If a separate written Custom agreement expressly conflicts with these Terms, the Custom agreement prevails for the matters covered by that agreement.

Questions concerning these Terms, the Service or legal notices may be submitted using the contact details made available through GetSportWidgets.

Information identifying the legal entity operating GetSportWidgets, together with the legally required business and contact information, is available in the Legal Notice accessible through the GetSportWidgets website.
